These Terms of Service (“Terms”) govern your access to and use of the Belanzy platform, including our websites, mobile experiences, and related services (collectively, the “Service”).

By creating an account, accessing, or using Belanzy, you agree to these Terms.

1. Overview of the Service

Belanzy is a digital platform that enables businesses to:

• Create and share QR-based menus and locations
• Accept orders and manage customer interactions
• Manage business settings, categories, and menu items
• Process payments through integrated third-party payment providers
• Access analytics and operational tools

Belanzy may offer subscription plans with varying features, limits, and pricing.

2. Eligibility

• Be at least 18 years old
• Have the legal capacity to enter into a binding agreement
• Use the Service in compliance with all applicable laws

If you create a business account, you confirm that you are authorized to act on behalf of that business.

3. Your Account

3.1 Registration

• You must provide accurate, complete information when creating an account.
• You are responsible for keeping your login credentials confidential.

3.2 Security

• You are responsible for all activity that occurs under your account.
• If you suspect unauthorized access, contact us immediately at support@belanzy.com.

3.3 Account Termination

• We may suspend or terminate accounts that violate these Terms.
• We may suspend or terminate accounts used for illegal activities.
• We may suspend or terminate accounts that pose security or operational risks.
• You may delete your account at any time.

4. Use of the Service

• Misuse, disrupt, or interfere with the platform
• Reverse-engineer, copy, or reproduce the Service
• Engage in fraudulent, abusive, or illegal activities
• Upload harmful or unsafe content
• Circumvent any restrictions or authentication measures

We reserve the right to remove content that violates these Terms.

5. Subscription Plans & Payments

5.1 Billing

Access to certain features requires a paid subscription. Plans, prices, and limits are provided during signup or within your billing settings.

5.2 Payments

• Payments are processed securely by Stripe.
• You authorize us and Stripe to charge your selected payment method.
• We do not store full card details.

5.3 Auto-Renewal

Subscriptions automatically renew unless canceled. You can manage or cancel your subscription at any time through the Stripe Customer Portal or your Belanzy billing settings.

5.4 Upgrades & Downgrades

Plan changes may take effect immediately or at the start of the next billing cycle, depending on Stripe’s rules.

5.5 Refunds

• Refunds are handled in accordance with our refund policy and applicable consumer laws.
• We may deny refunds for unused time or user error unless required by law.

6. Business Data & Customer Content

By using Belanzy, you may upload:

• Menu items, categories, photos
• Business information
• Order-related data
• Text or branding assets

You retain ownership of your content.

You grant us a limited license to process and display it as needed to provide the Service.

You confirm that you have rights to all content you upload and that it does not infringe any third-party rights.

7. Payments & Orders via Your Business

• Fulfilling orders
• Providing accurate pricing and descriptions
• Complying with food, safety, and business regulations
• Customer service and refunds to your end-customers

Belanzy is not a party to any transaction between you and your customers.

8. Third-Party Services

• Stripe for payments
• Hosting & infrastructure providers
• Email services
• Error monitoring and logging

Your use of these services is subject to their own terms and policies.

9. Data Protection & Privacy

Your personal data is handled in accordance with our Privacy Policy, available at:

By using Belanzy, you acknowledge that we process data according to our Privacy Policy.

10. Service Availability & Updates

• We strive to provide reliable access but do not guarantee uninterrupted service.
• We do not guarantee error-free operation.
• We do not guarantee zero downtime or delays.

We may update, modify, or discontinue parts of the Service at any time.

11. Intellectual Property

Belanzy, including the platform, software, branding, design, and content, is the intellectual property of ICREATOR B.V.

You may not copy, resell, or exploit any part of the Service without our permission.

12. Limitation of Liability

• Belanzy is provided “as is” and “as available.”
• We are not liable for lost revenue, lost data, business interruption, or indirect damages.
• Our total liability shall not exceed the amount paid by you in the last 12 months of your subscription.

This does not limit liability where prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless ICREATOR B.V. from any claims, damages, losses, or expenses arising from:

• Your use of Belanzy
• Content you upload
• Violation of these Terms
• Violation of laws or third-party rights

14. Termination

Conditions

• You violate these Terms
• Your payment fails
• You misuse the platform

Effects

• Your account may be deleted
• Your access to data may be restricted
• Some data may be retained as legally required (e.g., invoices)

15. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.

Any dispute will be resolved in the competent courts of the Netherlands.

16. Changes to These Terms

We may modify these Terms from time to time.

If changes are significant, we will notify you (e.g., email or in-app notice).

Continued use of Belanzy after changes means you accept the updated Terms.
